Iowa City Arrest Records

An arrest occurs when a suspect is taken into custody for the purpose of booking a suspect on a criminal charge. Criminal charges are an accusation, not a conviction. Whenever a person is charged with a crime or drunk driving, the allegation is made by the state, which the state must prove. If the state proves that the case is true, then the defendant is convicted of the crime or crimes. The Iowa Department of Public Safety is the department of chief enforcement in any Iowa city.

Iowa City Police Department

The Iowa City Police Department conforms to statutory and judicial requirements pertaining to arrests.The Iowa Code Section 804.5 defines arrest and taking a person into custody in the manner authorized by law, including restraint of the person(s) if necessary. If possible, officers are required to use a less restrictive, reasonable method to accomplish their goal.The arrest decisions will be based on the facts that surround an incident.

Procedures of Arrest

An officer is authorized to make an arrest in accordance with a warrant delivered to the arresting officer.
Arresting without a warrant is permitted if:
a) a public offense is committed in the presence of a peace officer.
b) a public offense has been committed and the peace officer has reasonable grounds for       believing that the suspect has committed that crime.
c) the peace officer believes that an indictable offense has been committed and has       reasonable grounds for arresting the offender.
d) If a peace officer receives from the Department of Public Safety or from any other peace    officer of the state or any other official communication in the form of bulletin, radio, telephone, telegraph or any other medium, informing him that a warrant has been issued for a person's arrest.  
e) If the peace officer has reasonable grounds for arresting a person on the grounds of domestic violence or abuse as defined in the section 236.2.

Prisoners' Treatment – while making an arrest, an officer will use only that amount of force that is necessary. Appropriate respect shall be given to the prisoners. Ill treatment and verbally harassing the prisoner while taking in to custody is strictly prohibited. Medical treatment will be made available when the arrestee is injured or any other general orders.    

Arrest or Citation

Persons who are charged for simple misdemeanors can be released on a promise to appear in front of the court at a specified date and time. In cases involving juveniles, they shall be handled in accordance with departmental directives that pertain to juveniles.

- Place and length of residence
- References
- Criminal record
- Present and past employment
- Family relationships
- Circumstances and nature of the alleged offense
- Other relevant facts that determines a person’s citation

An officer can take a cited person to medical facility if it appears that it is necessary to give him medical care, even if the citation has been issued.

Indictable Arrests

Persons who are charged with a serious misdemeanor or above are arrested and transported to Johnson County Jail, unless other arrangements are approved by the supervisor. The departmental directives pertaining to prisoner transport shall be adhered to while transporting the prisoners.
 

Arrest with a Warrant

Chapter 804 of the Code of Iowa law contains the authority to arrest persons with a warrant.

Section 804.6 of the Iowa Code deals with the person authorized to make an arrest. An arrest pursuant to a warrant shall be made by the peace officer, in other cases an arrest may be made by a private person or a peace officer. 

As per the section 804.7 (4) of the Code of Iowa, a peace officer can make an arrest with a warrant. If the peace officer has received any instruction from the department of public safety or any other government authority informing him that an arrest warrant order has been issued against a person on a designated charge, then the officer has the authority to arrest that person.

Service of arrest warrants

Warrants will be prioritized as
- felony warrants
- warrants for persons known to be violent or potentially dangerous
- warrants for indictable offenses
- non-violent misdemeanor warrants

Prior to serving a warrant outside the corporate Iowa City limits, the officer shall
- advise the ECO of the action
- obtain the permission of a watch supervisor
- Contact the local agency with jurisdiction and request the presence of a local officer during the arrest.
