How to Access Colorado DUI Records

The law of Colorado prohibits a person from driving a vehicle while under the influence of drugs or alcohol while the person’s ability to drive is impaired by alcohol or drugs. The offenses which are a result of consuming excessive amounts of drugs and alcohol are known as “DUI” and “DWAI”, respectively.

Breath or blood tests play a prominent role in the enforcement of the drunk driving laws, although a DUI or DWAI offense can be proved with the help of other means. Under the Implied Consent law in the state of Colorado it is presumed that every driver has accepted to take the breath, blood and saliva or urine test when they are requested for it by a law enforcement officer who has probable reason to believe that the person is legally intoxicated and is capable of committing a DUI or DWAI offense. If the person who has been asked to take the tests refuses to undergo the tests it will lead to the suspension or the revocation of his driver’s license.

There are both criminal penalties and administrative penalties for drunk driving cases. The courts in these cases have the right to impose criminal penalties. The Colorado Department of Revenue imposes certain administrative penalties. The penalties of this kind include the suspension or revocation of the driving license due to certain offenses or the collection of sufficient points assessed for the violations.

Sometimes a driver may decrease his or her criminal penalties with the help of a plea bargain in the court or by simply undergoing a drug or alcohol treatment, but this will not save them in any way from the administrative penalties that is assessed by the Revenue Department.
