Learn About Colorado Warrant Rules and Regulations
Warrants are writs that are served by law enforcers who dictate an offender to admit himself before the court for specific causes. Warrants are executed by a police officer, county sheriff or a constable. These writs are generally issued by the court but these can also be generated from authorized officials like magistrates, municipal judges, legislative officials and sometimes political bodies. The county-wise Colorado warrants which have been outstanding for a long time or issued for serious crimes are directed nationwide.
Various Types of Warrants in Colorado
Warrants are sectioned as arrest warrants, search warrants and execution warrants. Arrest warrants are defined as court orders which are mandated by law enforcement officials for arresting and bringing before the individual subjected in the warrant. These are issued for conducting a criminal investigation by a law enforcement body or if a defendant fails to obey the order of the court or if the case is of a defendant’s non-compliance.
Search warrants are court orders for conducting a search in order to find evidences related to a criminal case. An execution warrant is issued after an individual is held with a death sentence due to a criminal act. The arrest warrants can be further subdivided as bench warrants and outstanding warrant. The outstanding warrant is one which has not been executed. A bench warrant orders for the immediate arrest of the subjected person. The most common types of Colorado warrants issued by this state are “Failure to Appear” warrants. These writs generally appear for missing traffic court dates.
Maintenance of Warrants
All warrants are commissioned by the Colorado Bureau of Investigation after being executed by the deputies. Warrants are maintained in the Colorado Department of Corrections, United Service Marshals Service, Interpol and DEA. The warrants section of Boulder County manages all types of warrants generated by the Twentieth Judicial District. This division includes the county, district, civil courts within the Boulder County. This division inputs the active warrants in the National Crime Information Network and Colorado Crime computer databases. Thousands of warrant files are maintained in this way in all the other counties of Colorado. This database is controlled by the FBI.

Clearing a Warrant Record
Once a warrant is executed, the particular individual should immediately report to the court from where the warrant was issued. To resolve a “failure to appear” warrant, a specific hearing date will have to be set. Generally expungement of a warrant is not granted but under certain conditions, the individual can appeal to the court for the clearance of the record. In that case, you have to primarily file a petition with the court of jurisdiction. Colorado warrants can be cleared under the following conditions- • The offender is found innocent • The individual did not go for a trial • The individual receives a withheld adjudication where the result of the probation is pending. • The case is dismissed • The petitioner receives a deferred sentence • The individual was not prosecuted.
