Administrative Procedures

In cases where no hearing is requested, the license will be revoked at the end of 15 days.
The Motor Vehicle Administrative hearings are generally held to ascertain:
1. Whether a law enforcement officer had probable cause to believe that the driver was operating a motor vehicle under the influence of alcohol or drugs.
2. If there is predominance of facts that indicate that the motor vehicle driver was driving under the influence of drug or alcohol. If the chemical test shows a rating of 0.08% or greater, it is sufficient to prove that the driver was driving under the influence.
3. Whether the driver refused to undergo a BAC test after being informed of the penalty for not undergoing the test.

3 months for 1st offense 12 months for 1st refusal
12 months for 2nd offense 18 months for the 2nd refusal
18 months for 3rd offense or more 2 years for the 3rd refusal

DUI Court Procedures
During arraignment, a driver may apply for enrollment in the first offender program instead of standing a trial. The court in this matter will notify the Division of Motor Vehicles. There are some criminal penalties that are related with court convictions:
First Offense
• Fine of $230 to $1150
• Revocation period of 12 -24 months
• Imprisonment of not more than 6 months
Multiple Offenses
• It will be elevated to a felony charge if it is the individual’s third offense or more within a span of five years.
• Revocation period of 24-60 months
• Imprisonment
All DUI sentences are carried for a minimum of five years on the driving record. The driver’s license will not be reinstated for offenses such as DUI unless and until the driver completes the course of instruction satisfactorily or the program of rehabilitation. A program of this nature is to be determined by a screen evaluation procedure.
