Learn About Delaware Warrant Rules and Regulations
The issuance of the Delaware warrant is the responsibility of the judge at a court of law or a magistrate. A warrant gives the law enforcement authorities the power to arrest and detain a person or to conduct a search on a person or property.
Types of Delaware Warrants
A warrant can be issued for a number of reasons. The common types of warrants issued by the state of Delaware are as follows:
• Arrest warrants: An arrest warrant is issued when a court of law has ‘probable cause’ to believe that the individual is involved in a crime committed. Felony warrants are issued in cases of serious crimes like murder, homicide, battery, and such others.
• Search warrants: This type of warrants gives the law enforcement authorities the right to conduct a search of an individual or property on the basis of suspicion regarding the involvement in a crime committed.
• Bench warrants: In case an individual fails to appear at a court hearing a judge may issue a bench warrant against him or her. In certain cases bench warrants are also issued for offenses like an unpaid traffic ticket or something similar.
• Revenue warrants: The revenue warrants are issued by the Delaware Division of Revenue operating under the Department of Finance. These are issued when an individual does not pay his or her taxes in due time.
The issuance of the revenue warrants from the DE DOR follows a certain procedure. The first step involves the assessment of tax. Then the individual is sent a ‘Notice and Demand’ for the payment of the tax.
If the individual receiving the ‘Notice and Demand’ refuses to pay or neglects it, a ‘Notice of Judgment’ is filed at a Delaware Superior Court by the DE DOR. A warrant may only be issued after the lapse of 10 days of filing this notice.
The DE DOR does not need any court authorization for issuing a revenue warrant. For more information about the Delaware revenue warrants you can check the following link: http://revenue.delaware.gov/services/Collections/Warrant.shtml.
