Detroit Court Information, Location and Rules

There are five prominent municipal courts in the state of Michigan. Most of them handle cases related to misdemeanor as well as traffic and ordinance violation. Preliminary felony cases come up for hearing as well.

The city of Detroit does not have a specific Detroit Municipal Court. The 36th district court of Michigan serves as the “people’s court” for the residents of Detroit. This particular Detroit Court processes more than 500,000 cases annually. It does not have total authority over all kinds of cases and serves as a typical court of limited jurisdiction. Defendants can opt for a jury trial in the 36th district court of Michigan.

The chief judge of the district court presides over the entire staff consisting of 30 other judges and six magistrates. The court administrator maintains the documents of the court proceedings and is assisted by a 500 member strong team. The Recorder’s court of Detroit has been abolished since October 1st, 1997 when the division was merged with the circuit court of Michigan.

Detroit Court Jurisdiction

The 36th district court of Michigan is housed in the city of Detroit and has jurisdiction over certain types of misdemeanor as well as felony cases. All kinds of traffic including DUI and DWI offenses as well as local ordinance violations are exclusively handled by the court. Felony cases may not always be settled within the district court and the parties have the option of appealing to a higher court of law if the outcome proves to be dissatisfactory.

Apart from small claims cases limited to $3,000, the court hears civil suits for amounts up to $25,000. Landlord tenant disputes as well as land contract disputes are settled by the 36th district court of Michigan.

Offenders guilty of minor misdemeanors are often put on probation by the district court. The punitive measures include supervision by the appointed officials of the court. Rehabilitation of the offenders is undertaken as well. This is done with the sole intention of reducing the rate of repeat offenses.
