How to Request Georgia DUI and Driving Records

Every year in United States, thousands of people are killed or are permanently crippled and properties, worth millions of dollars, are damaged in road accidents involving drunken drivers. Recognizing this menace, all US states have tightened their drunken driving guidelines and enforcing harsher penalties and punishments on offenders. This has resulted in stricter DUI laws.

What is a DUI Charge?

A DUI or “driving under the influence” (of alcohol and/or other drugs) charge is almost identical to a DWI or "driving while intoxicated" charge. A person is charged with committing a DUI offense if she/he is proved guilty of driving a vehicle after consuming alcohol, banned drugs, or certain types of prescription and non-prescription medications.

The charge is not restricted to automobiles like cars, trucks, and bikes, but it also extends to all vehicles that may be used for work or recreational purposes. Thus, a boat, an airplane, jet-ski, farm machinery (like a tractor), and horse-drawn carriages may be involved in DUI crimes.

Georgia DUI Laws and Penalties

Georgia adheres to the general body of DUI laws adopted by the US states on August 2005. As per Georgia DUI laws, a person may be convicted of a DUI charge for these reasons:

1. If a police officer has reasonable evidence to believe that the driver operating a vehicle is intoxicated and thus his/her ability to drive is impaired, and/or
2. If the driver of the vehicle has a blood alcohol concentration (BAC) level of 0.08% or more.

Georgia DUI laws also follow the implied consent rule. As per the guidelines laid down by this rule, all drivers suspected of committing a DUI crime in Georgia have agreed to take a blood, breath, or urine test to determine the amount of alcohol in their system. If asked by a police officer, while conducting DUI investigations, the driver must comply. Refusing to do so will invite a DUI charge and result in the driver’s license being suspended.

A DUI conviction carries with it heavy fines and punishments, and these vary in severity depending upon whether the conviction is the result of a repeat offense or not. The following are the penalties in cases of a conviction for DUI in Georgia:

1. Mandatorily serving some period of prison sentence,
2. Paying fines,
3. Suspension of license for a specified period of time,
4. Serving a period of probation,
5. Performing some hours of community service, and/or
6. Attending the state Risk Reduction Program and availing of substance abuse treatment facilities.

The last penalty is mandatory for all multiple DUI offenders.

Why Do You Need to Search Georgia DUI Records?

DUI laws have been formulated and harsh penalties are imposed on DUI offenders in an effort to curb the menace of drunk driving. But there are still instances of convicted drivers that are continuing to operate vehicles with suspended licenses and offenders not completing alcohol and substance abuse treatment programs. Thus, it becomes necessary to sift through Georgia DUI records and identify these individuals or confirm your doubts about a suspected driver. This is an additional gateway to ensure that DUI crimes are not committed.

If you run a logistics company or a car hire service, it is a good idea to check your driver’s records to find out if he/she has ever been convicted of a DUI crime.

Also, if you have drivers employed under you and operating your vehicles, this reduces the chances of risk to your vehicles, the passengers, and also the people on the road.

Searching for Georgia DUI records is especially important if your child is availing carpool services or if you have hired a new chauffeur. This search should form an integral part of the criminal background check that you would normally perform before letting anyone gain access to your property or belongings.

Where to Search for Georgia DUI Records

A Georgia DUI conviction or plea of “guilty” is a permanent fixture of a driving record and is also listed in a convicted driver’s criminal history. This is reported to the Georgia Department of Public Safety and then to the National Driver’s License Registry. DUI records are documented and computerized here, and you may request to check the driving records of an individual.

A driving record from the National Driver Registry usually contains these details: the state of the license, mention of any instance when the license had been suspended or revoked, the name of the state where the offense was committed from the past five years, and reference to all DUI convictions in the past five years.

You will need to provide the first and the last name of the person whose records you want to look up and mention the state of the crime. The name of the city where the DUI offense had been committed is an additional bit of information that you may or may not want to provide.

The search mechanism in the website will instantaneously sift through hundreds and thousands of public and proprietary databases to look for the driving record you have requested.

A driving record search result at this site will contain these details: the name of the person, his/her past and present addresses, details of his/her physical appearance for ease of identification, and the details of the DUI crime that she/he has been convicted of. These results will be obtained all within a few minutes of keying in your request.

Searching for a Georgia DUI record is easy and results contain all the relevant information. So, before you entrust the keys to your vehicle to someone else, make sure that you have gone through their driving records. This is your way of ensuring that the roads of Georgia are safe for you, your family, and fellow citizens.
