Information About the Idaho Sex Offender Registry
The State of Idaho began the registration of sex offenders from July 1,1993. The state laws of Idaho makes it mandatory for offenders who are convicted of certain felony charges that deal with sex crimes to register themselves with a designated local law enforcement unit or with the local Sheriff’s Department of a particular county in Idaho.
The original act was wiped out by the state legislature in 1998 and replaced by another act called “Sexual Offender Registration Notification and Community Right to Know Act’. These acts were enacted to strengthen the exisiting program of the Idaho admininstration and also help to increase the scope of access by the general public to the information contained in the Central Registry of Idaho State. In addition, to the ‘Sexual Offender Registration Notification Act’ and the ‘ Community Right to Know Act’, the state legislature also passed the ‘Juvenile Sexual Offender Registration Notification and Community Right to Know’ Act in 1998. Before 1998, the state laws in Idaho did not require juvenile sex offenders who were convicted to register with the sex offender registry of the state. Only adult sex offenders were required to register with the sex offender registry.
Registration Laws
The new registration laws for sex offenders for both adult and juvenile offenders became effective from July 1, 1998. The details of the adult law can be found in Title 18 , Chapter 83 of Idaho Code under section 18-8301 to section 18- 3331. The details of the juvenile law under the new act can be found in Title 18, Chapter 84 of the Idaho State Code under section 18-401 to section 18-8414.
Sexual Offender Registration Notification and Community Right to Know Act
The findings of the Sexual Offender Rigistration Notification and Community Right to Know Act of 1998,indicate that sexual offenders pose a substantial risk to the community as these offenders can commit more such crimes in the future. In the interest of the community at large and to assist the local law enforcement agencies of the State of Idaho it is essential that sex offenders who are assigned a moderate to high level of risk to the community to not only register themselves with the designated local law enforcement unit but also be assesesd and monitored on an annual basis. Any change of residency, change of permanent address or movement of the sex offenders within Idaho State needs to be updated into the sex offender registry and monitored by the law enforcement agencies so that they can ensure the safety and well being of the communities by quickly apprehending sexual offenders within their jurisdiction.
The findings of the legislature also suggest that allowing the general public to access inforamtion about certain sex offenders help the parents to protect their children from these offenders. It helps the members of the communities in Idaho to be vigilant so that they can prevent the sexual offenders from recommiting crimes by notifying the Sheriff’s Department about any suspected sex offender in their neighborhood.
