Illinois Warrant Information
An Illinois warrant issued by a judge gives the law enforcement authorities the right to arrest and detain an individual. All warrants are issued only in the presence of a ‘probable cause’. This ‘probable cause’ must be present in an affidavit which needs to be signed and sworn. It must state that a particular crime has been committed and the person against whom the warrant has been issued has committed the crime.
Types of Illinois Warrants
There are various types of warrants are issued in the state of Illinois.
An arrest warrant is the most common type of warrant issued by an Illinois court of law. A warrant is required to conduct an arrest in cases of misdemeanor offenses that have been committed not in the presence of a law enforcement officer. This rule is not applicable in case of felonies. Illinois law enforcement agencies have the right to arrest the suspect of a felony, without a warrant, if there is ‘probable cause’.
A warrant may also give the law enforcement agencies the right to conduct a search of a person or property. These are known as search warrants. The search is conducted to locate evidence regarding a particular crime. The law enforcement authorities have the right to seize anything related to the crime as evidence by power of the search warrant issued by a court of law.
A bench warrant is another type of warrant issued by a judge. It is a specific kind of arrest warrant that legalizes the on-sight arrest of an individual. These warrants are issued with regard to both civil and criminal cases. A failure to appear for a court hearing or a failure to pay a traffic ticket on time is the common charges for which a bench warrant may be issued.
The arrest warrant which has not been served attains the status of an outstanding warrant. If the person against whom the arrest warrant was issued is evading the law enforcement agencies on purpose it may lead to the issuance of an outstanding warrant. A backlog in executing arrest warrants or lack of information can also be possible reasons behind the occurrence of an outstanding warrant.
