Details of Indiana Warrants

The Indiana warrants are maintained by the sheriff’s office of the different counties in the state. Outstanding warrants are issued by the county courts and served to the sheriff of the county for its implementation. Subsequent action on these arrest warrants can be taken by a law enforcement officer at any point of time by authorization made by the state statute.

Types of Indiana Warrants

The arrest warrants in the state remain valid for a specific period of time. This holds true for misdemeanor warrants that expire after a period of 3 months. If the offender is not arrested within that span, a fresh warrant has to be re-issued by the court. If there is inadequate evidence supporting the charge, then the charges would be dropped altogether.

But a warrant does not expire if it is issued against a felony charge. The warrant remains active till the time the individual named in the warrant is arrested. But the complete lack of evidence can lead to the revocation of the charges. Individuals can check if a warrant has been issued against their name by checking the website of the respective county sheriff.

If you find your name in the list, then you can contact your lawyer for a plan of action before turning yourself to the court or the local law enforcement agency. The Indiana county courts also issue search warrants which empower the law enforcement officer to look into designated places and also confiscate things that have been mentioned in the warrant.

The warrants are issued for the unlawful acquisition of property, for the commitment of a crime, possessing firearms as mentioned in Indiana Code 35-47-14-1. These offenses may lead to the issuance of a warrant against the individual. An Indiana warrant is also issued for a default in tax payment. According to the state statutes, the Indiana county sheriffs are assigned the responsibility of collecting missed state taxes.

These taxes may pertain to the categories of sales tax, corporation liability or even failure to pay individual income taxes. The state statute entails that the Indiana department of Revenue files a lien in the office of the County Clerk. Taxpayers are informed and asked to clear their dues. No payment of taxes may result in the issuance of a tax warrant from the county courts in Indiana. Tax warrants in the state are processed through a tax warrant interface specifically created fro the purpose as an initiative of the state Department of Revenue or the DOR and the Judicial Technology and Automation Committee.
