Michigan Warrant Details
A Michigan warrant can be issued against an individual for arrest under certain circumstances. If any individual receives a citation ticket given by a law enforcement officer in any city under the criminal procedure rule as stated in the Michigan Superior Court, and fails to solve the matter, then a warrant can be issued by the respective county court for arrest of the concerned individual.
If the court issues a warrant against you for arrest, you will be intimated about it in writing within a period of fourteen days from the date of issuance. The written notification will be mailed to the address available from the court database. If the individual against whom the Michigan warrant of arrest has been issued is unaware of the existence of such warrant, he will still be held liable for breaching the law of the state
Types of Warrants
As a Michigan warrant can only be issued under certain circumstances, here are some of the circumstances that demand the issuance of a warrant:
• If one fails to appear for a court hearing pertaining to show cause (Bench Warrant).
• If one fails to pay or is a defaulter for court ordered costs and fines.
• If one does not comply with the sentencing order given by the Judge’s of the court.
• If one does not agree on the terms of probation.
• If one fails to complete an assignment on work program.
• If one fails to schedule a date of arraignment.
• A warrant can be issued against a person if the law enforcement officers have enough evidence against the accused individual.
A different type of Michigan warrant known as the search warrant is used by the Michigan police department, if they have enough reasons to believe that searching a specific area can lead them to evidence essential for solving the crime.
Clearing Michigan Warrant
If the court issues an outstanding Michigan warrant for arrest or one believes that he might have an outstanding warrant, the best way to deal with it without further delay is to contact the court responsible for issuing the warrant. If there is any delay in resolving the matter, it can result in further court sanctions which in turn, can result in additional fines/penalties or jail time. If the warrant issued against you is for a traffic law violation then you can have your driving privileges suspended. If one is caught in the act of driving with a suspended license, it will result in additional legal problems.
Expungement of Michigan Warrant Records
If you are subjected to an arrest warrant, there are three ways to expunge it:
• A warrant can be cleared, if the offense for which it was issued can be resolved by paying a fine to the court.
• You can postpone the date of your hearing before the Judge of the court simply by posting a bond for a future court hearing date.
• You can visit the court in person and appear before the judge to resolve the matter related to an outstanding criminal or traffic warrant and to get it cleared.
If anyone is incarcerated and has an outstanding warrant with a district court in Michigan, then that individual can always request a plea through mail. For instance you can contact the warrant division of the 19th District Court’s warrant division by accessing http://www.ci.dearborn.mi.us/courts/warrant.shtml for further information.
But felony offenses like rape and murder can never be wiped off your record and they stay on the NCIC maintained by the federal government. If you manage to get it erased from the public records it still remains on the NCIC as the database contains all relevant records. There is only one way to get your record expunged is by submitting a petition to the state backed with enough evidences that the accused is falsely charged of the crime.
Warrant Record Check
The fastest way to track the Michigan warrant record is by accessing the Sheriff’s office or the local police department to know about the status of the outstanding warrants. Both the offices provide warrant records to the public over phone if they inquire about a specific person’s warrant record. You can also visit the courthouses or the office of the clerk of courts for any information about Michigan warrant records. You can visit the court departments by accessing http://coa.courts.mi.gov/ or the Sheriff’s departmenthttp://www.missaukee.org/ .
