Access Mississippi DUI Information

Driving under influence (DUI) in Mississippi is considered to be an offense and you are liable to be arrested and face penalties. The penalties increase with the severity of the offense and on repetitions of DUI offenses.

If the police officer found you driving unsteadily, he/she can stop you and ask you to take a few field sobriety tests and also test your blood alcohol content (BAC). if the BAC measurement is .08% or more, you will be arrested on DUI charges. A person below 21 years of age, driving and having a BAC of .02% or more will violate the Mississippi drinking and driving laws. The legal limit of BAC for those driving commercial vehicles is .04%.

Note that a Mississippi DUI conviction will stay on your driving record for a period of 5 years. If there are additional DUI offenses in these 5 years, the punishment may be increased further.

The MS DUI case triggers two different kinds of cases, the court case and the Department of Motor Vehicles (DMV) case. MS DUI arrests invoke administrative license invocations, which mean that if the accused has a BAC of .08% or more, his/her license will be taken away immediately and the accused can save the license by requesting the Mississippi DMV at once.

By choosing to drive under the influence of alcohol, drugs or any other kinds of intoxicating substances, an individual is bound to risk his/her career.  Note that if you have been convicted for drunk driving or impaired driving in another state, it can show up in Mississippi records as well.

DUI Penalties

The first DUI offense for adults results in a fine of $250-$1,000 along with payment of court costs, imprisonment of 48 hours, and license suspension for 1 year.

The second DUI offense if made within 5 years of the first offense will make the person liable to pay a fine of $600-$1,500 along with court costs. This offense can result in license suspension for 2 years, serving jail time of 5 days to 1 year and doing community service for 10 days to 1 year. Your car can also be impounded.

The third offense committed within 5 years gets you subjected to 1 to 5 years incarceration at the State Penitentiary, suspension of driver’s license for 5 years, felony conviction and seizure of the vehicle.

DUI Records

The MVR or motor vehicle record of Mississippi contains details of your driving history including the information related to DUI convictions. It is possible to order a copy of your own driving record from the Department of Public Safety, Mississippi. The department also has an online resource at https://www.ms.gov/hp/drivers/license/motorVehicleReportBegin.do for the purpose of viewing driving records. A State driver’s license and credit card are the only requirements for accessing the details of your records online. The driving record that is viewed over the Internet is for providing you with information only and the printed form of this record is not treated as a bonafide certified copy of the record.

The hard copy or certified version of your driving record can be obtained by submitting a completed driving record request along with the requisite fee of $11. The specified request form can be downloaded from the official website of the concerned department at http://www.dps.state.ms.us/dps/dps.nsf/allforms/2FB71E1F564A70CE86256D20006CF026/$File/DPPA-3.pdf?OpenElement. The State of Mississippi does not permit individuals to access the driving records of another individual. Such requests are usually not entertained unless accompanied by the specified consent form from the individual in question. It is, therefore, essential t o provide your prospective employer with a consent form containing your signature in order to allow him/her to conduct the required background check.
