How to Access North Carolina DWI Records

DWI or drinking while intoxicated is a serious offense in North Carolina. And a tougher stance is taken if you are caught with an existing North Carolina DWI case. The “Booze it and lose it“campaign of North Carolina Department of Transportation denotes the codifications of the DWI laws for the offenders. The DWI law takes in both the impaired charge and the per se charge. The state’s DWI laws are chiefly governed by the North Carolina General Statute Sect. 20-138.1 and Sect. 20-16. The DWI penalties are divided into five levels of convictions.

North Carolina DWI Laws and Penalties

Under this level of offense the license ID is suspended for 1 year. The offender goes through a substance abuse treatment and assessment. These offenders are those who were not convicted of DWI within the past seven years, those who had a clear driving record and those whose licenses were never confiscated. The second time offenders face a license suspension of 4 years; ignition interlock systems are fitted in their cars and they also have to pass an alcohol assessment and substance abuse treatment. The third graded offenses are referred to as felonies if there are other offenses recorded in the last 10 years. The fourth graded offenders are also charged with similar kinds of punishment as mentioned above. The level five convicts are ordered for a 24 hours jail or community service or the combination of both.

The fines for a level five offender includes court cost of $100, license revival fee of $50, community service charge of $200, attorney fees and alcohol assessment fees. Other than these the insurance charge of the particular vehicle increases to a limitless amount. The penalty total for a level five offender is quite high. These offenders are also ordered community service and go through alcohol assessment tests.

The Alcohol Drug and Training School (ADETS) is an institution which supervises drunken behavior and assists them with special reformatory courses. In North Carolina the Division of MH/DD/SAS looks after this operation.
