Cobb County Court Information
The Cobb County civil and criminal court were created by the Georgia General Assembly in 1970. These courts were chosen as state courts. The State Court of Cobb County is a court of limited jurisdiction. It was created as a subordinate of the Superior Court in order to spare the latter of some of its caseload. Since the time of its formation, the Cobb County State Court has been served by twelve full-time judges and a staff consisting of thirty employees. The Sentence Enforcement Unit has been served by thirty-six part-time workers and a team of twenty-one full-time workers.
Cobb County Court Jurisdiction
The Cobb County State Court deals with matters related to civil lawsuits, eviction cases, foreclosures of personal properties, misdemeanor cases, garnishments, and traffic infraction cases. It also holds preliminary hearings for many cases. A six-member jury hears all criminal cases. In some special cases like civil cases where the amount of money claimed is more than $25,000, a twelve member jury can be summoned. The Clerk of the state court looks after the administrative functions of the court.
Civil and Criminal Divisions of Cobb County
The civil and criminal division of the State Court of Cobb County holds jury trials Monday through Friday from 8:30 a.m. to 5:00 p.m. These times are subject to change. The State Court’s jurisdiction authorizes it to hear criminal cases that are below the level of felonies. It cannot hear civil cases that are to be heard by the Superior Courts. It is also vested with the power to issue arrest warrants and search warrants.
Traffic Division
The traffic division of the State Court is entitled to judge people charged with traffic violations. Certain traffic violations are payable in advance. Superior Court
Unlike the State Court, the Superior Court of Cobb County is a general jurisdiction court and it hears appeals from administrative agencies. The State Court and the Superior Court have intersecting jurisdiction in some cases like misdemeanors, contract violations, etc. There are some cases however, over which the Superior Court has exclusive jurisdiction. These include divorce cases, death penalty cases, felonies that require jury trials and land dispute cases.
This Cobb County Court is served by ten judges elected to serve a four-year term. They hear jury trials, motions, and decide on verdicts. The address and contact information is given below:
