Cobb County DUI Penalties and Records

In Georgia, a DUI or driving under the influence charge is quite serious. Records of such an offense can follow a driver for several years to the remainder of their life, and even result in hefty fines and jail time in some cases. A Cobb County DUI charge will result if a driver is pulled over and tests reveal a BAC (blood alcohol level) of more than 0.08, though the Cobb County Sheriff may arrest someone with a lower BAC if the driver seems significantly impaired regardless.

First-time offenders receiving a Cobb County DUI charge are typically given up to 10 days in the county jail, though this time is strictly up to the overseeing judge. Maximum penalties include up to 12 months of jail time, an additional 12 months of probation, up to 40 hours of community service, required completion of an alcohol education course, alcohol evaluation, and up to 12 months' suspension of the offender's driver's license.

Maximum penalties for second-time offenders receiving a Georgia DUI in Cobb County include 90 to 12 months of jail time, 12 months of probation, fines of up to $1000, 30 days of community service, up to three years' suspension of the driver's license, installation of a court-ordered ignition device in the driver's vehicle, and alcohol evaluation and education.

When a third DUI offense is charged in Cobb County, fines can be as high as $5000 and jail time must be a minimum of 15 days, up to one year. The driver's license is also revoked for up to five years. After four Cobb County DUI charges, the offender is considered a felon, and can serve up to five years in prison with a minimum of 90 days. They must also perform up to 60 days of community service.
