Jefferson County Court Information
All Colorado County Courts are courts of limited jurisdiction. The Jefferson County Court (in Colorado) also serves as a combined court of the 1st Judicial District of Colorado. The only other court belonging to the division is the county court of Gilpin. The court located at Jefferson County shares certain jurisdiction over name change issues with the district court. The combined court structure enables the Jefferson county court to handle restraining orders. Protection orders are handled as a matter of routine by the combined county court of Jefferson.
Jurisdiction
The Jefferson County court located in the state of Colorado has limited jurisdiction over a number of civil and criminal disputes that are regularly filed at the court. The criminal cases usually include a variety of misdemeanors as well as petty offenses. Preliminary trials for all criminal cases are normally heard at the county level. Jurisdiction over criminal matters is shared by the district court of the 1st judicial division.
Civil cases limited to an amount of under $15,000 come under the jurisdiction of the Jefferson County Court. Foreclosures of Liens are the most common type of cases filed. Other cases include offenses arising from forcible entry or unlawful detention especially when there is no dispute over the boundary of the property in question. Landlord tenant dispute issues come up for hearing at the county court of Jefferson. The landlord can sue his tenant for damage of property. The case is usually referred to a higher court if the amount exceeds $15,000. Rental issues are also resolved by the court but only if the monthly rent payable to the landlord is less than $15,000.
The Small Claims division of the Jefferson County Court is extremely limited in jurisdiction and handles cases amounting to $7,000 only. The small claims court is not permitted to hear cases of libel, defamation or slander and has absolutely no jurisdiction over injunctions, contact cases or traffic misdemeanors. Jury trial is not permitted at the Small Claims Court of Jefferson County.
The County Court has no jurisdiction over probate matters or family matters related to annulment, divorce, child custody and visitation issues. Guardianship, adoption or juvenile delinquency cases do not come under the jurisdiction of the County Court. All cases related to the above are handled by the district court section.
