Louisiana Sex Offender Registration Laws
The term ‘sex offenders’ refers to the individuals who have been convicted of sex offenses as well as those who have been convicted of offenses against minor victims. There are specific offenses which can lead to the attaining of the status of a ‘sex offender’ of an individual. These offenses are divided into different categories. According to the offenses the accused individual is termed either a ‘sex offender’, or a child predator’ or a criminal charged with ‘aggravated assault’ accusations. Each of the offenses is outlined by a particular statute according to the Louisiana Criminal Code.
Louisiana Sex Offenses
The details of the different levels of the Louisiana sex offenders and the crimes that justify them as ‘sex offenders’ are as follows:
Tier I Sexual Offenses:
• Simple Rape under subsection (3)
• Interference with child custody - other than by parent
• False Imprisonment of child under 18 with weapon
• False Imprisonment of child under 18 - other than by parent
• Incest
• Intentional Exposure to Aids
• Indecent Behavior with Juveniles
• Sexual Battery of Victim 18 and over
• Felony Carnal Knowledge (except if waived by court pursuant to 15:542(F)(2)
• Crime against Nature
• Contributing to the Delinquency of Juveniles
• Voyeurism
• Video Voyeurism
• Prohibited employments or occupations of Minors under 16
Tier II Sexual Offenses:
• Sexual Battery of Minor under 18 years of age
• Human Trafficking
• Oral Sexual Battery
• Molestation of a Juvenile
• Aggravated Incest under circumstances not in Tier III
• Computer Aided Solicitation
• Prostitution: Persons under 17
• Possession, Production and/or Distribution of Child Porn
• Enticing of minor into Prostitution
• Pandering when victim is under 18 years of age
Tier III Sexual Offenses:
• Forcible Rape
• Aggravated Rape
• Simple Rape under subsection A(1) and (2)
• Aggravated Kidnapping of a minor
• Second Degree Sexual Battery
• Second Degree Kidnapping of a minor under 18
• Simple Kidnapping of a minor under 18
• Aggravated Kidnapping of a child
• Aggravated Incest involving sexual intercourse, 2nd degree sexual battery, or oral sexual battery
• Sexual Battery of the Infirm
• Aggravated Crime against Nature
The individuals convicted of Tier I Sexual Offenses need to register for 15 years, those for Tier II Sexual Offenses register for 25 years and those for Tier III Sexual Offenses register for lifetime. Louisiana Sex Offender Registration Program
The first laws enacted by the state of Louisiana with regard to sex offender registration program were done in 1992. The law made it compulsory for all sex offenders to register with the authorities. Louisiana sex offender registration program was to be done by the units working in the field of law enforcement, i.e. the local parish, the sheriff’s office and/or the local police department. The sex offender registration information that is accumulated by the sheriff and the local police department is forwarded to the Department of Public Safety and Corrections, Office of State Police, Bureau of Criminal Identification and Information (the Bureau).
The Louisiana Sex Offender Registry operates according to the federal and state laws. At the time of registration, the individual needs to submit all information including full name and aliases, date of birth, addresses, name and address of the school or place of employment (as applicable), two proofs of residence (for each address), photograph, all details about the crime he or she was convicted of, identifiers like fingerprints, DNA samples and so on, social security number, vehicle details and so on.
